These Terms and Conditions govern use of www.jasonleephotography.ca (the “Site”), purchases through the Site or a linked client gallery, and mini photo sessions booked through the Site. The Site is owned and operated by Jason Lee, doing business as Jason Lee Photography (the “Photographer,” “we,” or “us”). By placing an order or booking a session and agreeing to these Terms and Conditions at checkout, the customer (the “Client”) agrees to the applicable terms below. The product or session details shown before checkout form part of the order. A separately signed photography agreement governs a service to the extent it expressly differs from these website terms.
THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE. PLEASE READ IT CAREFULLY.
1. Intellectual Property
Photographs, text, logos, graphics, documents, and other Site content are owned by Jason Lee Photography or used with permission. Site content may not be copied or used commercially without permission. Rights to photographs delivered to a photography client are set out in the applicable photography agreement or the licence below.

2. Age Restrictions
The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.
3. Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
- Violate the intellectual property rights of the Site owners or any third party to the Site; or
- Act in any way that could be considered fraudulent.
If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.
4. Products and Orders
The Site and linked client galleries may offer fine art nature prints, portrait prints, albums, calendars, cards, gifts, and other physical goods. The applicable page identifies the product, price, options, and availability. We make reasonable efforts to describe products accurately.
The colour and brightness of an image on a screen depend on the display, its settings, and the surrounding light. Minor differences between an on-screen image and a finished print are to be expected. We use reasonable care to produce the image and product ordered. This does not limit rights if a product is defective or materially different from its description or the approved proof.
We may decline or cancel an order if an item is unavailable, cannot be fulfilled, or contains a material listing or pricing error. If we cancel an order after payment, we will refund the amount paid for the cancelled item.
5. Mini Photo Sessions
This section applies to mini photo sessions booked through the Site. The selected session’s date, time, location, duration, fee, and included deliverables shown before checkout and in the order confirmation form part of the booking. The terms in this section govern the mini-session service.
5.1 Payment and booking
The full session fee and applicable taxes are due at checkout. Half of the session fee is a booking deposit that reserves the selected time and is applied toward the total price. The booking is confirmed when payment is accepted and an order confirmation is issued. The Client must provide accurate contact information and arrive at the selected location on time. Late arrival does not extend the reserved session time.
5.2 The session and client cooperation
The Client acknowledges having reviewed the Photographer’s portfolio and accepts the Photographer’s artistic judgment in posing, composition, image selection, and standard editing. The Photographer will make reasonable efforts to capture the participants but cannot guarantee a particular pose, expression, or image. The Client must provide information reasonably needed for the session and supervise participating children. The Photographer may stop an unsafe session or one affected by threatening or hostile conduct, giving a warning where reasonably practical.
5.3 Client cancellation and rescheduling
The Client must request cancellation in writing by email or through the Site contact form. If the request is received at least seven full calendar days before the scheduled start, the Photographer retains the booking deposit and refunds the other half of the session fee, together with the applicable tax on the refunded amount. If the request is received less than seven full calendar days before the scheduled start, or the Client does not attend, the full session fee is retained, subject to applicable law. If the Client asks to reschedule, the Photographer will try to accommodate another available mini-session time, but a replacement time is not guaranteed. Any change must be agreed to by the Photographer.
5.4 Weather and Photographer cancellation
If weather or conditions make the planned location unsuitable or unsafe, the Photographer will contact the Client about a reasonable alternative date or location. If the Photographer cannot provide the session because the Photographer is ill, has an emergency, or is otherwise unable to perform, the parties may agree to reschedule. If no alternative is agreed upon, the Photographer will refund the amount paid for the unprovided session. Nothing here limits rights under applicable law.
5.5 Image delivery and gallery access
Within seven calendar days after the mini session, the Photographer will make edited, high-resolution images available through an online gallery. The Photographer will deliver the images meeting their professional standards; no fixed number is guaranteed unless the session description says otherwise. Raw and unedited files are not provided. The gallery will remain accessible for at least 120 days. The Client is responsible for downloading and backing up the delivered images during that period.
5.6 Copyright and client licence
The Photographer retains copyright in all images created during the session. Once the session is paid for and the edited images are delivered, the Client receives an irrevocable, non-exclusive licence to download, print, display, and share the delivered images for personal, non-commercial use, including personal social media, cards, and announcements. Cropping to fit a social media format is permitted. The Client may not sell or license the images, or use them for business promotion or other commercial purposes, without the Photographer’s prior written permission. Any such permission may require an additional fee agreed upon before the use. An opt-out from the Photographer’s image use does not affect this personal-use licence.
5.7 Photographer use of images and written opt-out
The Client grants the Photographer permission to use the Client’s likeness for the Photographer’s portfolio, website, social media, advertising, editorial submissions, professional competitions, and accreditation submissions. The Photographer may also provide selected images to vendors involved in the session for those vendors’ own portfolio or promotional use. Before the session, the Client is responsible for informing every other adult participant, and a parent or legal guardian of every minor participant, about these uses and vendor sharing and for obtaining their permission. By placing the booking, the Client confirms that this permission has been obtained for each participant whose identifiable image may be used or shared. If permission has not been obtained for a participant, the Client must notify the Photographer by email before the session so that the participant’s image is excluded from these uses. Any participant may also send a written opt-out to [email protected] before the session; a parent or legal guardian may do so for a minor. The Photographer will honour an opt-out. Opting out does not affect the Photographer’s copyright or the Client’s personal-use licence.
5.8 Optional products
Prints and albums are not included unless the session listing says otherwise. Additional products ordered through the gallery are governed by the product, album, shipping, and returns provisions below.
6. Album Design and Approval
After receiving the selected images and the information needed to design an album, we will provide an initial proof within five business days. The Client is asked to approve it or request revisions within five business days of receiving it. Additional revisions may affect the completion date. The album will be submitted for printing only after the final proof is approved. Changes after approval may not be possible; any additional available charge will be disclosed before proceeding.
7. Cancellations and Final Sales for Goods
7.1 Separately purchased albums
The price of a separately purchased album includes a $100 design fee. If the Client cancels before design work begins, we will refund the amount paid. Once the first design proof has been provided, the design fee is earned. If the Client then cancels before we submit the approved album to the supplier, we will refund the amount paid less the $100 design fee. After submission to the supplier, the album cannot be cancelled or refunded for a change of mind. An album included in a photography package is governed by that package’s agreement; this clause does not create a separate refund for an included album. All of these terms remain subject to applicable law.
8. Preparation, Shipping, and Pickup
Our usual estimates for an order to be ready to ship or ready for pickup are:

The preparation time for metal prints and other goods will be stated with the applicable product or order information. Estimates exclude transit from us to the customer and do not include weekends or statutory holidays. The applicable delivery or pickup method, charges, and expected delivery information will be made available before checkout. Shipped goods are sent by postal carrier or courier.
The customer must provide a complete and accurate delivery address and contact us promptly about any error. Orders outside Canada may incur duties, taxes, or fees imposed by the destination country; unless stated otherwise at checkout, the recipient is responsible for those charges.
9. Delays
We will use reasonable efforts to fulfill orders within the stated timeframe. If we become aware of a material production or shipping delay, we will notify the customer as soon as reasonably possible and provide an updated estimate. The parties may agree in writing to a revised delivery date. If fulfillment is not possible, we will work with the customer on an appropriate solution. Nothing in this section limits statutory cancellation or refund rights.
10. Damaged, Defective, or Incorrect Goods
If an item arrives damaged, defective, or different from the order or approved proof, please contact us promptly with the order number and photographs of the item and packaging if available. We will review the issue and, where a remedy is appropriate, arrange a replacement or refund as appropriate to the circumstances and applicable law. Contact us before returning an item so we can provide instructions and arrangements for any necessary return.
11. Payments
Payment methods available for each order are shown at checkout or on the invoice. By submitting payment, the customer represents that they are authorized to use the selected method. The itemized price, applicable taxes, delivery charges, and total payable will be shown before an online order is placed.
12. Consumer Protection Rights
Nothing in these Terms and Conditions excludes or limits any right or remedy that cannot be excluded or limited under applicable consumer protection law. In the event of a conflict, the applicable mandatory provision governs.
13. Privacy and Links
Personal information submitted through the Site is handled in accordance with our Privacy Policy at https://www.jasonleephotography.ca/privacy-policy/. The Site may link to third-party websites or services that we do not control; their own terms and privacy policies apply.
14. Applicable Law and Disputes
These Terms and Conditions are governed by the laws of the Province of Manitoba, subject to mandatory laws that apply to a transaction.
If a dispute arises from an order, booking, or use of the Site, please contact us at [email protected] with the order or booking details and a description of the issue. We will make reasonable efforts to respond and resolve the matter through discussion. Either party may bring an eligible claim in small claims court or another court with jurisdiction if the dispute is not resolved within 14 calendar days after written notice is received. The parties may instead agree in writing, after the dispute arises, to use mediation or arbitration and agree on the process and allocation of costs. Either party may seek urgent injunctive relief or bring an intellectual property infringement claim in a court with jurisdiction without waiting 14 days. Nothing in this section limits any non-waivable right or remedy under applicable law.
15. Severability and Changes
If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. We may update these terms from time to time. The version made available when an order is placed governs that order unless the parties agree otherwise or applicable law requires otherwise. We will post the current version and effective date on the Site.
